01 Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of whirlwindsteels.com (the "Site") and the fabrication, metalwork, welding, and related services offered by Whirlwind Steels ("Whirlwind Steels," "we," "us," or "our"). By accessing the Site or submitting a request through it, you agree to be bound by these Terms. If you do not agree, do not use the Site.

02 Use of the Site

  • You must be at least 18 years old, or acting on behalf of a business, to submit a request through the Site.
  • You agree to provide accurate, current information when requesting a quote or contacting us.
  • You agree not to use the Site in any way that could damage, disable, overburden, or impair it, or interfere with anyone else's use of it.
  • We may suspend or restrict access to the Site at our discretion, including in response to misuse.

03 Quotes, Estimates & Services

  • Quotes and estimates provided through the Site, by email, or by phone are preliminary and subject to confirmation after a full review of drawings, site conditions, and material availability.
  • Final pricing, timelines, and scope are governed by the written proposal or contract issued for a specific job, which controls over any preliminary estimate.
  • Material costs are subject to market fluctuation; significant changes between quote and confirmed order may require a revised price.
  • Nothing on the Site constitutes a binding offer to perform work until a proposal is accepted in writing by both parties.

04 Email & Electronic Communications

To comply with applicable law, including the CAN-SPAM Act, the following terms apply to any email communication between you and Whirlwind Steels.

4.1 Consent to contact

By submitting the contact form, requesting a quote, or otherwise providing your email address to us, you consent to receive transactional email related to that request (quotes, invoices, scheduling, and job status updates). We will only send marketing or promotional email if you separately opt in, as described in our Anti-Spam Policy.

4.2 Your right to unsubscribe

You may withdraw consent to marketing email at any time using the unsubscribe link in any marketing message, or by emailing unsubscribe@whirlwindsteels.com. We process opt-out requests within the timeframe set out in our Anti-Spam Policy. Unsubscribing from marketing does not cancel transactional messages tied to an active job.

4.3 No use of our systems to send spam

If we ever provide you with access to any email, quoting, or communication tool connected to our systems (for example, a contractor or partner portal), you agree that you will not:

  • Send unsolicited bulk or commercial email ("spam") through our systems;
  • Send email to any address obtained through purchased, rented, harvested, or scraped lists;
  • Falsify header, sender, or routing information in any message sent through our systems;
  • Send content that generates excessive spam complaints or bounce rates, or otherwise abuses our email infrastructure;
  • Use our systems to distribute malware, phishing content, or deceptive material.

Violation of this section is grounds for immediate suspension of access.

4.4 Accuracy of contact information

You agree to keep the contact information you provide to us accurate and up to date, so that transactional communications (such as invoices and scheduling updates) reach you reliably.

05 Prohibited Conduct

In addition to Section 4.3, you agree not to:

  • Submit false, misleading, or fraudulent information through the contact form;
  • Use the contact form or any Site functionality to send spam, unsolicited advertising, or automated bulk submissions;
  • Attempt to gain unauthorized access to our systems, servers, or data;
  • Scrape, harvest, or collect email addresses or other contact data from the Site;
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity, when contacting us.

06 Intellectual Property

All content on the Site, including text, graphics, logos, and designs, is owned by or licensed to Whirlwind Steels and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from Site content without our prior written consent, except for your own personal, non-commercial reference.

07 Disclaimers

The Site and its content are provided "as is" without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Preliminary quotes and estimates are illustrative and do not guarantee final pricing, availability, or timelines.

08 Limitation of Liability

To the fullest extent permitted by law, Whirlwind Steels will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or reliance on preliminary quotes, even if advised of the possibility of such damages. Our total liability arising from your use of the Site shall not exceed the amount, if any, you paid to us in the 12 months preceding the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.

09 Indemnification

You agree to indemnify and hold Whirlwind Steels harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your violation of these Terms, misuse of the Site, or any content or information you submit to us.

10 Governing Law

These Terms are governed by the laws of the jurisdiction in which Whirlwind Steels is registered to do business, without regard to conflict-of-law principles. Any disputes arising from these Terms or use of the Site will be resolved in the courts of that jurisdiction, unless otherwise required by applicable law.

11 Changes to These Terms

We may revise these Terms from time to time. The "Last updated" date above reflects the most recent revision. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
